AHIP Files Amicus Brief Supporting Supreme Court Review of Challenge to Duplicative Pharmaceutical Patents

AHIP has filed an amicus brief with the Supreme Court supporting review by that court of a case involving duplicative pharmaceutical patents. Mylan Pharmaceuticals, Inc. v. UCB, Inc. In this case, a drug manufacturer had obtained multiple, duplicative patents on the same antiepileptic drug, creating a monopoly on the manufacture of the drug stretching over a quarter of a century. AHIP’s brief supports Supreme Court review encouraging the court to correct the overly rigid test applied by the Federal Circuit that protects duplicative patents and makes it more difficult for generic drug companies to combat this type of gamesmanship by brand-name manufacturers.
